The really important bits

  • If you enter this Competition and the Categories (if applicable) you will be bound by these Terms and Conditions.
  • You must be over the age of 18 to enter.
  • All entrants must be resident in the UK (excluding Northern Ireland).
  • Entries will only be accepted from 17:00 BST on 01 August 2023 and will close on 18:00 BST on 15 October 2023.
  • All entries and photographic submissions must be personal and photographed by you. You cannot enter on behalf of another person.
  • All entries must be submitted in high resolution JPEGs, with a minimum of 300 dpi resolution and at least 1080 pixels in width. No photographic image uploaded may be larger than 15 MB.
  • All images must be of historical significance with an accompanying explanation of the significance.
  • Manipulating the image in a way which would be likely to mislead or which would alter the nature of the image or subject, including photoshopping two different compositions together, shall invalidate the entry.
  • You are entitled to enter the Competition a maximum of five (5) times (and if an image is submitted to a Category as well, it will count as one (1) entry).

By entering this Competition or any Category of it, you are agreeing to be bound by these Terms and Conditions and you meet the eligibility criteria herein.

1. The Promoter

Hit Networks Limited (with registered company number 10559854), of Level 3, The Truman Brewery, 91 Brick Lane, E1 6QL, London, United Kingdom (Promoter) is the promoter of this Competition and the Categories.

2. The Competition and Categories

2.1 The title of the competition is ‘Historic Photographer of the Year Competition 2023’ (Competition). Entrants who enter the Competition can also elect for the same photographic image to enter one of the following further prize categories: ‘Historic England’ (HE Category) and ‘World History’ (WH Category) (each a Category and together the Categories) and be eligible for an overall Competition prize or a Category prize.

3. How to enter the Competition and the Categories

3.1 The Competition and Categories will be open from 17:00 BST on 1 August 2023 (Opening Date) and will close on 18:00 BST on 15 October 2023 (Closing Date).

3.2 All Competition entries and Category entries must be received by the Promoter by no later than 18:00 BST on the Closing Date. All Competition entries and Category entries received before the Opening Date or after the Closing Date will not be considered.

3.3 To enter the Competition, entrants must upload their photographic image and complete the mandatory fields required at the following website: photographer.historyhit.com (Website). Only one photographic image can be entered per entry. Entrants may also choose to enter the same photographic image into either of the Categories by selecting their chosen Category in the ‘Optional Category’ field on the Website. If the entrant does not add any Categories to this field, then their photographic image shall be entered into the Competition only. An internet connection is required to enter the Competition and the Categories.

3.4 At the time of entry, entrants must fully comply with all entry fields on the Website including completing the following mandatory fields about themselves and their entry: (i) entrant’s full name; (ii) entrant’s email address; (iii) entrant’s town/city; (iv) details of the historic site featured in the entrant’s entry; and (v) details about the entrant’s entry. Entrants must also confirm by checking opt-in boxes when submitting their entry on the Website that (i) the copyright of all images entered belongs to them and they personally took the photograph; (ii) they have read and accept these Terms and Conditions; (iii) no one has objected to being featured in their entry and they have informed anyone featured of their rights; and (iv) no trespass or unlawful act was committed in taking of, or the production of, the image. Any incomplete entries will not be considered.

3.5 Competition and Category entries cannot be returned.

4. Requirements of the Competition and Category entries

4.1 All entries must be photographic images. All entries must be submitted in high resolution JPEGs, with a minimum of 300 dpi resolution and at least 1080 pixels in width. No photographic image uploaded may be larger than 15 MB. Winning and selected entrants may be required to provide the original RAW file (or JPEG as shot) at the Promoter’s discretion.

4.2 Entries must be made using a camera, smartphone or tablet, digitally or using film. In all cases, files (or scans in the case of images on film) must be uploaded onto the Website. No print submissions will be accepted.

4.3 The subject of all entries for the Competition and the Categories must be of a location which has historical significance and entrants must explain the relationship of the location with a significant historical event as part of their entry. Entries for the Competition may be of a historical location anywhere in the world. Entries for the HE Category must be of a historical location taken in England. Entries for the WH Category must be of a historical location taken in any country other than England.

4.4 The Promoter will not accept entries that are:

(a) automatically generated by computer;

(b) completed by third parties or in bulk;

(c) illegible, have been altered, reconstructed, forged or tampered with;

(d) photocopies and not originals; or

(e) incomplete.

4.5 Entrants are not permitted to manipulate the image in a way which would be likely to mislead or which would alter the nature of the image or subject, including photoshopping two different compositions together.

4.6 By entering into the Competition and Categories, the entrant confirms to the Promoter that: (i) they are the original author of their entries; (ii) they have obtained all consents for any third party materials to be included in their entries and the Promoter does not need to make any further payment in respect of these materials; (iii) any identifiable individuals in their entries have expressly consented to being featured in the entries and have been made aware of the use of the entries that is going to be made by the Promoter; (iv) the entries do not contain anything that is offensive, indecent, illegal, pornographic, harassing, threatening, violent, defamatory; (v) the entries do not contain anything which may bring the name or reputation of the Promoter into disrepute; and (vi) no trespass or unlawful act was committed in taking of, or the production of, the image. The entrant hereby indemnifies and shall keep indemnified the Promoter and its group companies, officers, directors, employees, agents, representative and sub-contractors against all actual or alleged claims, demands, damages and losses suffered by the Promoter (or any of the foregoing) arising as a result of a breach of any of the entrant’s confirmations under this section 4.6 of these Terms and Conditions.

4.7 There is a limit of five (5) entries per person – if the same photographic image is submitted into the Competition and either of the Categories it will be considered as just one (1) entry. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

4.8 Entries that do not fulfil the above criteria will be deemed ineligible and disqualified. Where this is discovered after any prize has been awarded, the prize must be returned or refunded by the entrant

5. Eligibility

5.1The Competition and Categories are only open to entrants who are residents in the United Kingdom (excluding Northern Ireland) and are aged 18 years or over. Entrants must not be:

(a) employees of the Promoter or any of its holding or subsidiary companies;

(b) employees of agents or suppliers of the Promoter or any of its holding or subsidiary companies, who are professionally connected with the Competition, the Categories or its administration; or

(c) members of the immediate families or households of (a) and (b) above.

5.2 The Promoter may require you to provide proof that you are eligible to enter the Competition and the Categories.

5.3 Entrants that do not fulfil the above eligibility criteria will be deemed ineligible and their entries disqualified. Where this is discovered after any prize has been awarded, the prize must be returned or refunded by the entrant.

6. The prizes

6.1 The prizes for the Competition and the Categories are as follows:

(a) Competition: one (1) prize of £250 GBP (two-hundred and fifty Great British Pounds).

(b) HE Category: one (1) prize of £50 (fifty Great British Pounds) and up to £100 (one hundred Great British Pounds) worth of books selected from the Historic England imprint.

(c) WH Category: one (1) prize of £50 GBP (fifty Great British Pounds).

6.2 The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value.

6.3 The Competition and each Category shall be won by a different entry.

6.4 The prizes are not negotiable or transferable. There are no cash alternatives for the prize.

7. Judging

7.1 The Competition entries and Category entries will be judged by a panel of five judges based on their originality, composition and technical proficiency alongside the story behind the image and its historical impact.

7.2 A list of names of the judges can be viewed on the Website from the Closing Date for a period of 30 days.

8. Winners

8.1 The decision of the judges is final and no correspondence or discussion will be entered into.

8.2 The Promoter will contact the winners of the Competition and each Category as soon as practicable after the Announcement Date, using the email address provided by the relevant entrant with the Competition entry or Category Entry.

8.3 The Promoter will publish the surname and county of major prize winners and their winning entries on the Website on 22 November 2023 (Announcement Date). This information may also be made available on any official Competition or Category partners’ websites and social media pages, as well as the Promoter’s social media pages.

8.4 If you object to any or all of your surname, county and winning entry being published or made available, please expressly state this in your email reply to the Promoter (as detailed further below). In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

9. Claiming the prize

9.1 The winners shall need to respond via e-mail to the Promoter’s email in section 8.2 within 30 days of the Announcement Date and shall need to provide any requested information by the Promoter in respect of claiming the prizes. For any cash prizes, these shall be paid by the Promoter via bank transfer and winners in their reply to the Promoter’s email shall need to provide the relevant details. In respect of the non-cash prize for the HE Category, the Promoter shall connect the winner with Historic England to organise delivery of this prize. The Promoter shall use reasonable endeavours to issue all prizes to the winners within 45 days of the Announcement Date, provided that it shall not be liable for any delays caused by the winner. The Promoter accepts no liability if the winner provides any incorrect information required to issue the prizes.

9.2 The Promoter will make all reasonable efforts to contact each winner. If a winner cannot be contacted by e-mail or does not provide the required information to issue the prizes within 30 days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the eligible entries.

9.3 The Promoter does not accept any responsibility if you are not able to take up the prize.

10. Limitation of liability

10.1 Insofar as is permitted by law, the maximum liability of the Promoter under these Terms and Conditions shall be limited to payment or delivery of the prizes of the Competition and Categories (as set out in these Terms and Conditions).

10.2 The Promoter will not accept:

(a) responsibility for Competition entries or Category entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

(b) proof of transmission as proof of receipt of entry to the Competition and Categories.

11. Ownership of Competition and Category entries

11.1 The entrant shall retain its rights of ownership in their Competition entry and Category entry.

11.2 You agree that the Promoter and any Competition or Category partner may, but is not required to, (i) make your entry available on the Website, its social media pages and any other media, whether now known or invented in the future, and in connection with any publicity of the Competition and/or the Categories and (ii) reproduce and exhibit (and authorise third parties to reproduce and exhibit) the entry in any exhibition in print or digital format and to use (and authorise third parties to use) the entry to publicise and promote any such exhibition. You hereby grant the Promoter a non-exclusive, sub-licensable, worldwide, irrevocable licence, for the full period of any intellectual property rights in the Competition or Category entry and any accompanying materials, to use, display, exhibit, reproduce, publish, transmit, copy, edit, alter, store, re-format and sub-licence the Competition entry and/or Category entry and any accompanying materials.

12. Data protection and publicity

12.1 The Promoter will only process your personal information as set out in these Terms and Conditions and with its privacy policy at https://www.historyhit.com/privacy-policy.

12.2 In addition to the data protection provisions as set out above, you acknowledge and understand that by entering the Competition and the Categories any information and personal data provided by you about you and any information provided by you about individuals as part of the Competition entry and Category entry will be used by the Promoter, its partners and service providers in order to administer and fulfil the Competition and Categories and for the purposes set out in these terms and conditions.

13. General

13.1 If there is any reason to believe that there has been a breach of these Terms and Conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Competition and the Categories.

13.2 The Promoter reserves the right to hold void, suspend or cancel the Competition and the Categories where it becomes necessary to do so.

13.3 These Terms and Conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
